General terms and conditions of business

1. Scope
All orders and services completed via the website thetinyfactory.ch are subject to the General Terms and Conditions of The Tiny Factory GmbH, hereinafter referred to as the T&Cs. By placing an order, the customer accepts these T&Cs. A customer is defined as any natural or legal person who maintains a business relationship with The Tiny Factory GmbH. By using this website or ordering goods, the customer confirms that they fully accept these T&Cs, including the shipping and payment terms.

2. Order and conclusion of contract
By submitting an order, the customer makes a legally binding offer to conclude a purchase contract. We will confirm receipt of the order by email. The contract is concluded as soon as this order confirmation is sent. If a product is unavailable, The Tiny Factory GmbH is not obligated to perform the service. In this case, the customer will be refunded the payment for the affected products. There is generally no right to return the products.

3. Prices
All prices are quoted in Swiss francs (CHF) and include VAT. Any shipping costs will be charged separately and are to be paid by the customer. These will be listed separately during the ordering process. The Tiny Factory GmbH reserves the right to change prices at any time and without prior notice.

4. Payment
The customer can choose from the payment options listed during checkout. Payment can be made by credit card, Apple Pay, or TWINT. Payment is due immediately.

5. Delivery, obligation to inspect and return
Delivery is made by mail or courier service to the delivery address provided by the customer. Orders are generally dispatched within two business days. The customer will be notified immediately of any delays. Invoicing is done directly via the online shop, by email, or by mail. Upon dispatch, the purchase price and risk are transferred to the customer, to the extent permitted by law.
If the delivery cannot be made or the customer refuses to accept the delivery, The Tiny Factory GmbH may terminate the contract by emailing the customer and invoice the customer for the associated costs. The customer is obligated to inspect the delivered goods immediately upon receipt and to report any errors or defects in writing by email or letter.
Returns to The Tiny Factory GmbH are at the customer's expense and risk. The goods must be sent in their original packaging, unopened, and complete, along with the delivery note and a description of the defects, to the address of the production site, which can be found in the imprint. If no defects are found during inspection, The Tiny Factory GmbH may charge the customer for the costs of the return shipment.

6. Right of withdrawal
There is no right of withdrawal for orders and services concluded via the website thetinyfactory.ch.

7. Complaints
Customer satisfaction is our highest priority, and The Tiny Factory GmbH always strives to find a solution that works for all parties involved. Any complaints must be reported within 48 hours of receipt of the goods by email to hello@thetinyfactory.ch or by phone at +49 78 829 99 44. Subsequent deliveries, exchanges, returns, or discounts on goods will only be accepted if the complaint is justified.

8. Transport damage
The Tiny Factory GmbH assumes no liability for transport damage that is not its own fault. Complaints regarding transport damage must be submitted directly to the transport company by the customer. The Tiny Factory should also be informed.

9. Liability
The Tiny Factory GmbH excludes all liability and claims for damages, regardless of their legal basis. All products offered by The Tiny Factory GmbH are subject to the strictest quality controls by the manufacturers. Therefore, the respective manufacturer is solely responsible for the quality of its products, and The Tiny Factory GmbH hereby transfers any claims that may exist against the manufacturer to the customer. By placing an order, the customer confirms that The Tiny Factory GmbH cannot be held liable for any complaints or problems.

10. Vouchers and discounts
Vouchers of any kind cannot be combined with other vouchers or discounts. Gift vouchers cannot be returned. Vouchers cannot be redeemed for cash. Only one discount, promotional, or gift voucher can be used per order.

11. Data protection
The Tiny Factory GmbH is entitled to process and use the data collected during the conclusion of the contract in order to fulfill its obligations under the purchase agreement. The data required to provide the services may also be passed on to commissioned service partners or other third parties.

12. Final provisions
Swiss law applies. The place of jurisdiction is Zurich. Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
